TERMS OF SERVICE – BAREHAND

These Terms of Service ("Terms") govern your use of our website, social media channels, and the purchase of our products. By placing an order with Barehand, you agree to be bound by these Terms.

1. Intellectual Property (Hak Kekayaan Intelektual)

Streetwear designs, graphics, and brand identity are the core of Barehand. This clause protects you from copycats and counterfeiters.

  • Ownership: All content included on our website, social media, and products—including but not limited to t-shirt designs, graphics, illustrations, typography, logos, text, and images—is the exclusive property of Barehand and is protected by Indonesian Intellectual Property Laws (Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta and Undang-Undang No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis).
  • Prohibitions: You are strictly prohibited from reproducing, copying, modifying, distributing, counterfeiting, or exploiting any of Barehand’s designs or brand assets for commercial use without our express written consent.

2. No Refunds & Exchange Policy (Kebijakan Pengembalian)

To protect your cash flow as a local brand while staying compliant with UU No. 8/1999 tentang Perlindungan Konsumen, this clause restricts returns strictly to your mistakes.

  • Final Sale: All sales are final. Barehand does not accept returns, refunds, or exchanges for "change of mind," style changes, or incorrect size selection made by the customer. Please consult our size charts carefully before purchasing.
  • Legal Exceptions: In compliance with Indonesian Consumer Protection Law, a refund or exchange will only be issued if the product delivered is proven to be factory-defective, damaged prior to shipping, or completely mismatched from your order due to our operational error.
  • Mandatory Unboxing Video: To claim an exception for a defect or wrong item, you must provide a continuous, unedited unboxing video (video unboxing) starting from the sealed, unopened outer package down to the physical item. This video must be submitted to our customer service within 48 hours of package delivery. Failure to provide this video voids any return claim.

3. Limitation of Liability (Pembatasan Tanggung Jawab)

This clause legally separates Barehand from issues caused by third-party delivery services (JNE, J&T, Sicepat, etc.) and digital screen differences.

  • Third-Party Logistics: Barehand operates out of Bandung. Once your package is handed over to our third-party logistics partners, Barehand is no longer liable for shipping delays, misrouting, theft, or transit damages caused by the courier. Any delivery complaints must be directed to the respective courier service.
  • Screen Display Variations: We make every effort to display our streetwear t-shirt colors and prints accurately. However, minor variations in color may occur due to individual digital screen calibrations. Barehand is not liable for these minor visual differences.
  • Maximum Liability: To the maximum extent permitted by the laws of the Republic of Indonesia, Barehand’s total financial liability to you for any claim arising from a transaction shall not exceed the actual purchase price paid for that specific item.

4. Governing Law & Jurisdiction (Hukum yang Berlaku)

This ensures any formal dispute is handled locally in your home city.

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
  • Any legal disputes, mediation, or lawsuits arising from these Terms or purchases from Barehand shall be settled exclusively within the jurisdiction of the District Court of Bandung (Pengadilan Negeri Bandung).
